These Terms govern your use of TryAsklyAI ("the Service", "we", "us"). By creating an account or using the Service you agree to these Terms.
You are responsible for activity under your account and for keeping credentials secure. You must be authorized to act for any store you connect.
Paid plans and credit packs are billed through Stripe. Subscriptions renew automatically until cancelled. Credits are spent per AI text message: the Standard model costs 1 credit per message, and more advanced models (Pro, Genius) cost more credits per message, as shown in-app. Credit and plan allotments are described in-app at purchase. Prices may change with notice.
For sales the Service directly recovers (for example, an abandoned-cart recovery link or a campaign discount code we send that results in a completed order), we charge a performance fee of 1% of that order's value. Accrued fees are added to your next invoice or may be paid early in-app; fees under $5 simply roll forward. You are only ever charged a performance fee when the Service generates a recovered sale for you.
You retain ownership of your contacts, messages, and store data. You grant us a limited license to process it solely to provide the Service. You are responsible for having the legal right and consent to contact your customers.
We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or carrier/messaging rules. You may cancel at any time.
The Service is provided "as is." To the maximum extent permitted by law, our liability is limited to the amount you paid us in the prior 12 months.
You agree not to use TryAsklyAI to:

TryAsklyAI sends SMS on your behalf to your customers. By using the Service you agree to follow all applicable messaging laws and carrier requirements (TCPA, CTIA, A2P 10DLC, and similar).
You must obtain prior express consent before texting a customer (e.g., an SMS opt-in checkbox at checkout). You must keep records of consent.
Recipients can reply STOP to opt out at any time and HELP for help; these are handled automatically and opted-out contacts are never auto-messaged again.
Message frequency varies by your campaigns. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. For help with messages you receive from a brand using TryAsklyAI, reply HELP or contact hello@tryasklyai.com.
Before a number can send, carriers require it to be registered. Toll-free numbers use a free verification that we submit for you. Local (10DLC) numbers require registration with the messaging industry registry, which charges a $4 brand registration fee. That $4 is a pass-through fee: we collect it solely to pay the registry and earn no profit on it. Local registration applications are reviewed by the carriers and are frequently rejected (commonly due to business-address validation). The $4 fee is non-refundable, including when an application is rejected. You may submit a new application after a rejection, but each submission incurs the $4 fee again. Toll-free verification avoids this fee, and we recommend it unless you specifically require a local number. You acknowledge and authorize these per-attempt charges when you submit a local-number registration.
You can buy a dedicated number for supported countries beyond the US and Canada. International numbers and the texts sent through them cost us more than US ones, and the amount varies significantly by country. To reflect this, two things scale by country: the number's monthly price, and the number of message credits each text costs. A text to a higher-cost country uses more credits than a US text (this multiplier is applied on top of the AI model tier you choose). The credit cost for a given destination is shown before you send. Some countries also require additional business verification (such as an ID or a local address) before a number can send, and a few charge a one-time regulatory setup fee, which is passed through to you. These rates are set by carriers and may change; we may update per-country pricing and credit costs from time to time to reflect our actual underlying cost, and continued use after an update constitutes acceptance of the new rates.
SMS marketing law and carrier requirements differ by country (for example TCPA in the United States, CASL in Canada, and GDPR/PECR in the UK and EU). Sending also has real technical limits: a United States or Canadian number (toll-free or 10DLC) can only reliably deliver to the United States and Canada, and most other countries require a local number and registered sender in that country.
For this reason, the Service currently sends only to contacts the platform is provisioned to reach (today, the United States and Canada). When a campaign includes contacts in other countries, those contacts are automatically detected and skipped, and you are shown which countries were skipped before sending. We do not attempt to deliver messages into a country we are not set up for. Reaching additional countries requires a local number and sender registration for each, which may be offered in the future; until then, you remain responsible for not texting recipients outside the supported countries through other means.
You can cancel your subscription anytime from Account → Billing; it stays active until the end of the current billing period and does not renew. Unused subscriber credits roll over for 15 days.
Subscription fees, one-off credit packs, and performance fees are non-refundable except where required by law.
When we process personal data of your customers on your behalf, you are the controller and we are the processor. We process such data only to provide the Service and apply reasonable security measures, including encryption in transit and access controls.
Our sub-processors are: Supabase (database, auth, hosting), Quo / OpenPhone (SMS delivery), Stripe (payments), our AI model provider (reply generation and analysis), and Shopify (store and order data). Data is retained while your account is active and deleted or anonymized within a reasonable period after closure unless a longer period is required by law. We will notify affected merchants without undue delay after becoming aware of a personal-data breach.
