TryAsklyAI ("TryAsklyAI", "we", "us") provides software that helps Shopify merchants communicate with their customers over SMS, including AI-assisted text conversations, automated flows and campaigns, and analytics. This Privacy Policy explains what information we collect, how we use it, and the choices available to you. By installing or using TryAsklyAI, you agree to this policy.
This policy covers two groups: merchants who use the TryAskly dashboard, and the customers of those merchants whose information is processed when a merchant uses TryAskly to message them. For merchant customers, the merchant is the data controller and TryAskly acts as a service provider/processor on the merchant's behalf.
Merchants are responsible for obtaining the legally required consent before messaging their customers and for complying with applicable laws (including the TCPA and carrier requirements). Recipients can opt out at any time by replying STOP, and opt-out requests are honored. Message and data rates may apply.
Messaging laws and carrier rules differ by country, and a United States or Canadian number can only reliably deliver to the United States and Canada. The Service currently sends only to contacts in the countries it is provisioned for (today, the United States and Canada). Contacts in other countries are automatically detected and skipped rather than messaged, and the merchant is shown which countries were skipped before sending.
We do not sell personal information. We share information only with service providers that help us operate TryAskly, under agreements that limit their use of the data, including:
We may also disclose information if required by law or to protect our rights and the safety of others.
We retain information for as long as a merchant's account is active or as needed to provide the service, and then delete or anonymize it within a reasonable period, unless a longer retention is required by law. Merchants may request deletion of their data as described below.
We use industry-standard measures, including encryption in transit and access controls, to protect information. No method of transmission or storage is completely secure, but we work to safeguard your data.
Depending on your location, you may have rights to access, correct, delete, or export personal information, or to object to or restrict certain processing. Merchant customers should direct these requests to the merchant they interacted with; we will assist the merchant in fulfilling valid requests. Merchants can contact us at the email below.
We may process and store information in the United States and other countries. By using the service, you understand your information may be transferred to locations that may have different data-protection rules than your own.
TryAskly is not directed to children and we do not knowingly collect personal information from children under 16.
We may update this policy from time to time. We will revise the "Last updated" date above and, where appropriate, provide additional notice.
